Chamber of Digital Commerce: XRP Decision Sets Legal Precedent

Fox reporter Eleanor Terrett shared on Twitter the Chamber of Digital Commerce's latest analysis and impact report on the Ripple decision. The Chamber was pleased to see that the court's interpretation of the issues surrounding the legal classification of digital assets was in line with the arguments outlined in its amicus brief. In its report, the Digital Chamber of Commerce summarised that a digital asset is separate from the investment contract itself, arguing that "the subject matter of the investment contract will therefore not be a security by its very nature. This is linked to the judgement of Judge Analisa Torres in which she stated that the subject matter of the investment contract is an independent commodity. And he stated that this is not an investment contract by its nature."

The Digital Chamber of Commerce report also called for comprehensive and effective legislation for the cryptocurrency industry to operate with regulatory clarity, saying, "As in our SEC and Ripple file, we will continue to work to draw a clear path for companies to launch digital asset products, prioritising both investor protection and innovation."
