French luxury house Hermès filed an order asking a New York court to stop NFT artist Mason Rothschild from selling or promoting MetaBirkin NFTs.
What Happened?
Hermès filed a lawsuit against Mason Rothschild alleging that he stole the luxury house’s intellectual property. Rothschild, who created MetaBirkins without permission, earned more than 200 ETH from sales. The MetaBirkins NFT collection depicts the brand's famous Birkin bags. In the first NFT trademark lawsuit in the world, Hermès won against Rothschild, and Rothschild was ordered to pay $133,000 in damages.
New demands from Hermès
Hermès asked United States District Court Judge Jed S. Rakoff of the Southern District of New York (SDNY) on Friday to permanently block Rothschild from selling or promoting NFTs that use the trademark Birkin, according to a report published by CoinDesk. Hermès demanded that Rothschild transfer control of MetaBirkin NFTs to a crypto wallet chosen by Hèrmes. Hermès also demanded the transfer of the royalties from the project and the control of the MetaBirkins smart contract, as well as related domain names and social media accounts.
