Grayscale filed a notice with the SEC. In its notification, it stated that the inability to staking Ethereum spot ETFs creates a major disadvantage. The company stated that the inability to staking will reduce the value of the fund and therefore may require changes to the agreement with the SEC. Since the SEC considers Ether staking returns as the sale of securities, it does not approve these returns in Ether spot ETFs, so many companies have removed staking from their applications.
